These general terms and conditions apply to all offers, quotations, orders and agreements between Mr-Refurb and its customers via www.mr-refurb.nl or otherwise concluded.
By placing an order, the customer agrees to these general terms and conditions and, where applicable, Mr-Refurb's privacy, shipping and returns policies.
If any provision of these terms and conditions conflicts with mandatory consumer law, the applicable mandatory law shall prevail.
Mr-Refurb primarily sells and supplies refurbished IT equipment and related products and services. Our webshop uses the Shopify platform.
Refurbished products are previously used products that have been inspected and, where necessary, tested, cleaned, repaired and/or made ready for use again. Depending on the stated condition, refurbished products may show cosmetic signs of use.
All products are inspected where applicable and supplied with the warranty stated for the product. Specifications, product descriptions and images are compiled with care. Minor deviations that do not materially affect the functionality of the product may occur.
The prices displayed in our webshop to consumers are in euros and include VAT, unless expressly stated otherwise.
The statutory VAT margin scheme may apply to certain used or refurbished products. When the margin scheme applies, VAT will not be stated separately on the invoice.
Any shipping costs and other additional costs will be shown to the customer before the order is completed.
Payment is made using the payment methods offered during checkout. If a payment cannot be processed, either in whole or in part, Mr-Refurb may suspend the processing of the order or cancel the order.
An agreement is formed after the customer has placed an order and Mr-Refurb has confirmed that order, except in the case of obvious errors in prices, product information or availability.
Delivery will be made to the delivery address provided by the customer when placing the order. The customer is responsible for entering the delivery address correctly and completely.
Orders may be processed and shipped by Mr-Refurb itself. Mr-Refurb may also use suppliers, distributors, fulfilment partners, and logistics service providers for the storage, processing, fulfilment, and shipment of orders.
An order or part of an order may therefore be shipped directly from a supplier, distributor, or fulfilment partner to the customer. In that case, the product does not need to be physically received by Mr-Refurb first.
For the fulfilment of such a delivery, Mr-Refurb may provide the necessary data to the relevant supplier, distributor, fulfilment partner, or carrier. This may include, among other things: name, delivery address, necessary contact details, order number, product details, item number/SKU, and the quantity ordered.
The processing and provision of personal data for the fulfilment of orders takes place in accordance with our Privacy Policy.
Stated delivery times are indicative, unless a fixed or guaranteed delivery date has been expressly agreed. In the event of a delay, the customer has the rights granted under the agreement and applicable legislation.
If an ordered product is unexpectedly unavailable, we will contact the customer as soon as possible. If delivery is not possible, any amount already paid for the unavailable product will be refunded.
When the customer is a consumer and the agreement was concluded remotely, a statutory withdrawal period of 14 days generally applies from the day on which the consumer received the product, unless a statutory exception to the right of withdrawal applies.
The consumer may examine the product during the withdrawal period to the extent necessary to establish its nature, characteristics, and operation, comparable to what would reasonably be possible in a physical store.
If the product has been used beyond what is necessary to establish its nature, characteristics, and operation, the consumer may be liable for the resulting reduction in value.
After a valid withdrawal, the product must be returned within the applicable statutory period.
The statutory right of withdrawal for consumers does not apply to business purchases (B2B), unless Mr-Refurb expressly agrees otherwise in writing.

Our refurbished products are supplied with a minimum of 12 months' warranty, unless a different warranty period is expressly stated for the product concerned.
A commercial warranty offered by Mr-Refurb does not affect consumers' statutory rights when a product does not conform to the agreement.
The commercial warranty generally covers hardware defects that arise during normal use. In principle, the commercial warranty does not cover:
In the event of a valid warranty or conformity claim, we will assess which solution is appropriate. Depending on the circumstances, this may include repair, replacement or a refund, taking into account the customer's statutory rights.
Mr-Refurb is liable for damage insofar as it can be attributed to Mr-Refurb under applicable law.
For business customers, Mr-Refurb is, insofar as legally permitted, not liable for indirect damage, consequential damage, loss of profit, missed savings, business interruption or loss of data.
The customer is responsible for regularly backing up important data. Data may be lost during the repair, recovery, replacement or servicing of data carriers.
No limitation or exclusion of liability in these terms and conditions applies insofar as such limitation or exclusion is not permitted under mandatory law.
The content of the website, including texts, design, logos and images, may be protected by intellectual property rights belonging to Mr-Refurb, E-trend Computers & IT, suppliers or other rights holders.
This content may not be copied, published or reused commercially without permission, unless permitted by law.
Mr-Refurb processes personal data in accordance with our Privacy Policy.
Personal data may, insofar as necessary for the processing and delivery of an order or the provision of a service, be shared with, among others, suppliers, distributors, fulfilment partners, carriers, payment service providers and other service providers.
When a supplier, distributor, or fulfilment partner ships an order directly to the customer, the customer and order details necessary for this purpose may be shared with that party. These may include the name, delivery address, necessary contact details, order number, product details, SKU/item number, and ordered quantity.
If Mr-Refurb is temporarily unable to fulfil its obligations due to circumstances beyond its reasonable control, performance of the agreement may be suspended for the duration of those circumstances, to the extent permitted by law.
Such circumstances may include, for example, serious disruptions affecting carriers or suppliers, power or network outages, strikes, natural disasters, government measures, or other circumstances beyond Mr-Refurb's reasonable control.
Consumers' statutory rights remain applicable.
For consumers, prices are shown including the applicable VAT, unless expressly stated otherwise. Mandatory additional costs are clearly displayed before the agreement is concluded.
The VAT margin scheme may apply to certain used or refurbished products. When the margin scheme applies, VAT is not listed separately on the invoice.
For business customers, prices may be shown excluding VAT if this is expressly stated.
Prices in quotations and other business offers are valid for the period stated therein. If no validity period is specified, Mr-Refurb may withdraw the offer as long as it has not yet been accepted.
Any one-off discounts do not automatically entitle customers to the same discount on future orders or agreements.
Dutch law applies to agreements with Mr-Refurb.
Disputes shall be submitted to the court with jurisdiction under the applicable statutory rules. For consumers, the mandatory rules regarding the competent court shall apply.

To the extent permitted by law, a business customer shall indemnify Mr-Refurb against third-party claims arising from the unlawful or improper use by the business customer of products or services supplied by Mr-Refurb, insofar as the damage in question cannot be attributed to Mr-Refurb.
Choice of software and configuration: when the customer selects hardware, software, or configuration options from the available choices, the customer is responsible for making a choice that suits the intended use.
Software after delivery: Mr-Refurb is not responsible for problems arising solely from software, settings, or changes installed or made by the customer or a third party after delivery, unless the problem can be attributed to Mr-Refurb.
Software updates: after delivery, the customer is generally responsible for carrying out regular software and security updates. This does not affect any statutory obligations of Mr-Refurb.
We advise customers to always make an up-to-date backup of important data before carrying out major updates, repairs, or changes.
Mr-Refurb may engage third parties to perform its obligations, including suppliers, distributors, fulfilment partners, repair partners, and logistics service providers.
To the extent permitted by law, Mr-Refurb may transfer rights and obligations under an agreement to a third party, provided that this does not affect the consumer's statutory rights.
The customer may transfer rights and obligations under an agreement insofar as this is permitted under the agreement and applicable law.
Due to the extensive and changing range of refurbished products, product photos do not always show the specific item that will be supplied.
Product images may be for illustrative purposes, and the product actually supplied may differ in minor respects, for example with regard to cosmetic signs of use, stickers, labels, or other non-functional characteristics.
Refurbished products have been used previously and may therefore contain cosmetic signs of use consistent with the stated product condition. The cosmetic condition is separate from the technical functioning of the product, unless expressly stated otherwise.
The main features and specifications of the product supplied must correspond to those stated for the product, except in the case of obvious errors. For information or photos of a specific item, Mr-Refurb may be contacted before placing an order.
