Article 1 – Applicability

These general terms and conditions apply to all offers, quotations, orders and agreements between Mr-Refurb and its customers via www.mr-refurb.nl or otherwise concluded.

By placing an order, the customer agrees to these general terms and conditions and, where applicable, Mr-Refurb's privacy, shipping and returns policies.

If a provision of these terms and conditions conflicts with mandatory consumer law, the applicable mandatory law shall prevail.

Article 2 – Services and products

Mr-Refurb primarily sells and supplies refurbished IT equipment and related products and services. Our webshop uses the Shopify platform.

Refurbished products are previously used products that have been inspected and, where necessary, tested, cleaned, repaired and/or made ready for use again. Depending on the stated condition, refurbished products may show cosmetic signs of use.

All products are inspected where applicable and supplied with the warranty stated for the product. Specifications, product descriptions and images are compiled with care. Minor deviations that do not materially affect the functionality of the product may occur.

Article 3 – Prices and payments

The prices displayed in our webshop to consumers are in euros and include VAT, unless expressly stated otherwise.

For certain used or refurbished products, the statutory margin scheme may apply. In that case, VAT is not stated separately on the invoice or deducted.

Any shipping costs or other additional costs are shown to the customer before the order is completed.

Payment is made using the payment methods offered during checkout. If a payment cannot be processed in full or at all, Mr-Refurb may suspend the execution of the order or cancel the order.

Article 4 – Orders and conclusion of the agreement

An agreement is concluded after the customer has placed an order and this order has been confirmed by Mr-Refurb, subject to obvious errors in prices, product information or availability.

If an ordered product is unexpectedly unavailable, we will contact the customer as soon as possible. If delivery is not possible, any amount already paid for the undeliverable product will be refunded.

Article 5 – Delivery and direct shipping by suppliers

Delivery takes place to the delivery address provided by the customer when placing the order. The customer is responsible for entering the delivery address correctly and completely.

Mr-Refurb may use suppliers, distributors, fulfilment partners and logistics service providers for the storage, processing, fulfilment and shipping of orders.

An order or part thereof may therefore be shipped directly from a supplier, distributor or fulfilment partner to the customer. In that case, the order does not first have to be physically shipped via Mr-Refurb's warehouse or registered office.

For the fulfilment of such a delivery, Mr-Refurb may provide the necessary information to the relevant supplier, distributor, fulfilment partner or carrier. This may include, among other things: name, delivery address, necessary contact details, order number, product details, article number/SKU and quantity ordered.

The processing of personal data in connection with such deliveries takes place in accordance with our Privacy Policy.

Stated delivery periods are indicative, unless an express fixed or guaranteed delivery date has been agreed. In the event of delay, the customer has the rights provided under the agreement and applicable law.

Article 6 – Right of withdrawal and returns

When the customer is a consumer and the agreement was concluded at a distance, a statutory withdrawal period of 14 days generally applies from the day on which the consumer received the product, unless a statutory exception to the right of withdrawal applies.

During the withdrawal period, the consumer may assess the product only to the extent necessary to establish its nature, characteristics and functioning, comparable to what would reasonably be possible in a physical store.

If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, the consumer may be liable for the resulting loss in value.

After a valid withdrawal, the product must be returned within the applicable statutory period.

The statutory right of withdrawal for consumers does not apply to business purchases (B2B), unless Mr-Refurb expressly agrees otherwise in writing.

More information about returns, return costs, and refunds can be found in our Returns and Refunds Policy.

Article 7 – Warranty and service

Our refurbished products are supplied with a minimum of 12 months' warranty, unless a different warranty period is expressly stated for the product concerned.

A commercial warranty offered by Mr-Refurb does not affect the statutory rights consumers have with regard to a product that does not conform to the agreement.

The commercial warranty generally covers hardware defects that arise during normal use. In principle, the commercial warranty does not cover:

  • damage resulting from improper or careless use;
  • damage caused by drops, impacts, pressure, moisture, or water;
  • damage resulting from unauthorised repairs or modifications;
  • software, configuration, malware, or virus problems that arose after delivery;
  • normal cosmetic signs of use consistent with the indicated product condition;
  • normal wear and tear of consumable components, to the extent permitted by law.

In the event of a valid warranty or conformity claim, we will assess which solution is appropriate. Depending on the circumstances, this may include repair, replacement, or a refund, taking into account the customer's statutory rights.

Article 8 – Refurbished products and product condition

The customer acknowledges that refurbished products may have been used previously. As a result, cosmetic signs of use may be present, such as light scratches, discolouration, or other signs of use consistent with the indicated product condition.

The cosmetic condition of a product is separate from its technical operation, unless expressly stated otherwise.

Article 9 – Product images

Due to the extensive and changing range of refurbished products, product photos do not always show the specific item that will be delivered.

Product images may be for illustrative purposes, and the product actually delivered may differ in minor respects, for example with regard to cosmetic signs of use, stickers, labels, or other non-functional features.

The main properties and specifications of the delivered product must correspond to those stated for the product, except in the case of obvious errors. For information about a specific item, Mr-Refurb may be contacted before placing an order.

Article 10 – Software, Configuration and Updates

Choice of configuration: when the customer selects hardware, software or configuration options from the available possibilities, the customer is responsible for making a choice that suits the intended use.

Software after delivery: Mr-Refurb is not responsible for problems arising solely from software, settings or changes installed or made by the customer or a third party after delivery, unless the problem can be attributed to Mr-Refurb.

Updates: after delivery, the customer is in principle responsible for carrying out regular software and security updates. This does not affect any statutory obligations of Mr-Refurb.

We advise customers to always make a current backup of important data before carrying out major updates, recovery work or changes.

Article 11 – Liability and Data Loss

Mr-Refurb is liable for damage to the extent that it can be attributed to Mr-Refurb under applicable law.

For business customers, to the extent permitted by law, Mr-Refurb is not liable for indirect damage, consequential damage, loss of profit, missed savings, business interruption or loss of data.

The customer is responsible for regularly backing up important data. Data may be lost during the repair, recovery, replacement or servicing of data carriers.

No limitation or exclusion of liability in these terms and conditions applies to the extent that such limitation or exclusion is not permitted under mandatory law.

Article 12 – Prices, Quotations and Discounts

Prices in quotations and other business offers are valid for the period specified therein. If no validity period is stated, Mr-Refurb may withdraw the offer as long as it has not yet been accepted.

Any one-off discounts do not automatically entitle the customer to the same discount on future orders or agreements.

For business customers, prices may be shown excluding VAT if this is expressly stated. For consumers, mandatory costs are clearly displayed before the agreement is concluded.

Article 13 – Force Majeure

If Mr-Refurb is temporarily unable to fulfil its obligations due to a situation beyond its reasonable control, performance of the agreement may be suspended for the duration of that situation, to the extent permitted by law.

Such circumstances may include, for example, serious disruptions affecting carriers or suppliers, power or network outages, natural disasters, war situations, government measures or other circumstances beyond Mr-Refurb's reasonable control.

Consumers' statutory rights remain applicable.

Article 14 – Intellectual property

The website content, including texts, design, logos and images, may be protected by the intellectual property rights of Mr-Refurb, e-Trend Computers & IT, suppliers or other rights holders.

This content may not be copied, published or commercially reused without permission, unless permitted by law.

Article 15 – Personal data

Mr-Refurb processes personal data in accordance with the Privacy Policy.

Personal data may, insofar as necessary for the fulfilment of an order or provision of services, be shared with, among others, suppliers, distributors, fulfilment partners, carriers, payment service providers and other service providers.

Article 16 – Transfer of rights and obligations

Mr-Refurb may engage third parties to perform its obligations.

To the extent permitted by law, Mr-Refurb may transfer rights and obligations under an agreement to a third party, provided that this does not affect the consumer's statutory rights.

The customer may transfer rights and obligations under an agreement to the extent permitted under the agreement and applicable law.

Article 17 – Indemnification by business customers

To the extent permitted by law, a business customer shall indemnify Mr-Refurb against third-party claims arising from the unlawful or improper use by the business customer of products or services supplied by Mr-Refurb, insofar as the relevant damage cannot be attributed to Mr-Refurb.

Article 18 – Applicable law and disputes

Dutch law applies to agreements with Mr-Refurb.

Disputes shall be submitted to the court with jurisdiction under the applicable statutory rules. For consumers, the mandatory rules concerning jurisdiction shall apply.
